Cost-Cutting Dismissal: Can UAE Employees Claim Compensation for Arbitrary Termination?

Cost-cutting can lead companies to review their workforce and operating expenses. But when an employee in the UAE is dismissed specifically as part of a cost-cutting exercise, an important legal question arises: can the employee claim compensation for arbitrary termination?

Under Article 43(1) of Federal Decree-Law No. 33 of 2021, either party may terminate an employment contract for good cause by giving written notice, generally between 30 and 90 days. Serving the contractual notice period does not by itself settle whether the employer had a valid reason for the termination. Where an employer relies on cost-cutting as the reason, the circumstances of the dismissal may therefore require closer examination.

What Does UAE Labour Law Say About Termination?

Under Federal Decree-Law No. 33 of 2021, either the employer or employee may terminate an employment contract for a legitimate reason, provided the other party is given written notice. The notice period must generally be between 30 and 90 days, according to the employment contract.

Serving the contractual notice period, however, does not by itself answer whether the termination had a valid reason. This distinction is important in cost-cutting cases. An employee may therefore need to consider not only whether the notice period was followed, but also the reason given for the dismissal and the circumstances surrounding it.

When Can a Cost-Cutting Dismissal Be Considered Arbitrary?

Article 47 addresses unlawful termination and provides compensation where its legal conditions are established. The UAE Labour Law states that dismissal is considered arbitrary where the employer terminates a worker because the worker submitted a serious complaint to MOHRE or filed a lawsuit against the employer that was proven valid. In a cost-cutting situation, the reason for dismissal and the circumstances surrounding the decision therefore require careful consideration.

The circumstances of each case matter. Employment records, performance history, communications from the employer and the stated reason for termination may all be relevant when assessing a dispute. For example, consistently strong performance records may help document the employee’s history, although they do not by themselves establish arbitrary dismissal.

Can Employees Claim Compensation?

Where a competent court finds that a dismissal is arbitrary under Article 47, the employee may be entitled to fair compensation.

The amount is determined by the competent court, taking into account factors such as the type of work, the extent of harm suffered and the employee’s length of service. The compensation for arbitrary dismissal cannot exceed three months of the employee’s last salary.

This compensation does not replace other employment entitlements. The law preserves the employee’s right to applicable pay in lieu of notice and severance or end-of-service benefits.

What About Notice Pay and Other Final Dues?

Even where a dismissal is not considered unlawful under Article 47, an employee may still have other financial rights.

If the required notice period is not followed, the party failing to observe it may have to pay compensation equal to the worker’s wage for the full notice period or the remaining part of it.

Depending on the circumstances, employees may also have rights relating to unpaid salary, unused annual leave and end-of-service benefits.

Is There an Exception for Severe Financial Problems?

There can be an important exception where an employer is genuinely unable to continue its activity because of exceptional economic circumstances beyond its control. Under Article 25(1)(b) of Cabinet Resolution No. 1 of 2022, an employment contract may be terminated where the concerned authorities issue a decision confirming the employer’s inability to continue its activity for such reasons.

This means that a genuine business shutdown arising from severe circumstances should be distinguished from an employer simply describing an individual dismissal as “cost-cutting.” The specific facts and any relevant authority or court decision can be important in determining the legal position.

What Should an Employee Do After a Cost-Cutting Dismissal?

Employees who believe they have been dismissed without a valid reason should preserve relevant documents before taking further action. This can include the employment contract, termination letter, salary records, performance appraisals, emails, messages and communications explaining the reason for termination.

It is also important to avoid signing documents without understanding what they contain, particularly where the document confirms settlement of employment claims.

An employee may consider filing a complaint with the Ministry of Human Resources and Emiratisation (MOHRE) seeking compensation and other applicable employment entitlements. MOHRE may attempt to resolve the dispute amicably. If a friendly settlement is not reached, the dispute may be referred to the competent court in accordance with the applicable procedures.
